Are juveniles above the law?

The release of the juvenile who was responsible for the rape and murder of Nirbhaya or Jyoti Singh clearly indicates that you can get away with anything if you are a juvenile. You can rape, murder, steal, bomb a city and yet get away with the minimum amount of punishment because the law recognizes you as a child who has gone wayward and is not adult enough to commit a crime.

Justice and punishment should be equal for all irrespective of age. When you are old enough to rape and murder women in cold blood then you are old enough to face the consequences of the crime you had committed. Image the pain and suffering that the parents of Jyoti Singh must be going through at this moment watching the man who killed their beloved daughter ruthlessly walk free.

The judicial system of India has many flaws and yet it has performed to the best of its limited abilities. But today is a black day for the judiciary. It has failed in its duty to deliver justice to all. The judiciary has failed Nirbhaya and the hundreds of young girls who are raped by juveniles. Is this justice? Are we failing our women? Are the judges blind to the physical and mental pain that the victim undergoes during and after the rape?

The release of the most perverted of rapist that India has ever seen is sending out a clear message to the hundreds of potential juvenile rapists that they can get away with anything if they are of a certain age. The number of rapes that happen in India may go up sharply after this flawed judgment.

There are many voices that claim that the courts and law may have dealt with the case differently if the individual that was raped happened to be a relative of a V.I.P. Even if this was true, making such a claim is bad as you can never wish or hope that an important person’s sister or daughter gets raped for the law to change. This is such a dangerous thing to wish. 


Laws need to evolve and change with the times. We need a law that guarantees speedy trial and justice. Justice delayed is justice denied. A sad day for India and the judicial system that has failed to protect its daughter. Hang all the accused in the Nirbhaya case to ensure that justice is done.
